On August 2, 2016 Elliott was arrested and booked on charges of intoxication manslaughter and intoxication assault. [1]
Elliott had consumed beer and liquor while floating the river at Texas State Tubes before veering into oncoming traffic and crashing into Fabian Guerrero-Moreno's car head on.
Moreno died at the scene, and his newly wed pregnant wife, Kristian Guerrero was rushed to the hospital, where her unborn child was also pronounced dead. [1]
Criminal history
On March 22, 2016 she was arrested for three felony charges of possession of a controlled substance and Marijuana. On May 2, 2016 she was arrested again on two felony charges of possession of a controlled substance.
In April 2018, Elliott has been sentenced to 14 years in prison.
Hays County Judge Jack Robinson ruled that Shana Elliott’s two seven-year sentences - one for killing 23-year-old Fabian Guerrero Moreno, and the other for killing his unborn baby - would run consecutively, according to KXAN-TV.[13]
Elliott’s earliest chance for parole will come in 2023, according to the Austin American-Statesman. Even if she gets parole, she’ll still have to serve the second count, then the two nights in Hays County Jail for the duration of her probation period. The third leg of Elliott’s sentence is 10 years of probation, according to the San Antonio Express-News. If Elliott is not paroled early and ends up spending the entire 14-year sentence in jail, she will not be on probation when she gets out.[13]
