On Wednesday November 15th, 2017, Fort Bend County Sheriff Troy Nehls posted on the official Facebook for the Sheriff's office essentially asking the driver to either remove the window decal with the demeaning message about the United States President, or to alter the message - otherwise he would be filing disorderly conduct charges against Fonseca.

Nehls wrote that several people in the community had complained about the truck and its message.

On Thursday afternoon November 16th, 2017 at around 2 p.m., Fonseca was arrested after an outstanding warrant for Karen Fonseca was issued by the Rosenberg Police

Department. She was booked in Fort Bend County Jail and remained there for about an hour before her bail was posted.

Lynne Rambo, a law professor at Texas A&M University specializing in the First Amendment, made a statement saying that the 1971 Supreme Court case made two points clear: the state’s attempt to regulate profanity or civil discourse is not a sufficient reason to justify restricting speech.
