David Fox is a Canadian resident of Peterborough, Canada. [1]
Arrest
On July 18, 2017, David was recorded on video beating a 74-year-old cyclist in Peterborough. [1] [undefined] The cyclist was traveling on Erskine Avenue at around 11:00 a.m. when he got involved in an argument with David. [1] [undefined]
Both men were making a left-hand turn on the road when the argument began.
David then exited his vehicle and beat the elderly man with a small club.
Fox has been charged with aggravated assault and assault with a weapon. [1] [undefined] He is scheduled to appear in court on August 24, 2017. [1] [undefined]
The case was (recently) adjourned until Nov. 15, when more disclosure - documents that outline the evidence in a case - is expected to be provided by prosecutors.
Fox's next court date is now Dec. 20, when lawyers will return to begin to discuss a resolution to the case.
His case was briefly addressed early Wednesday afternoon (Dec. 20) before Justice of the Peace Jason Mariasine in Peterborough Ontario Court of Justice and adjourned until Jan. 10.
The accused, who is being represented by Toronto-area defence lawyer John Whelton, was not present as the matter was prosecuted by assistant Crown attorney Jim Hughes.
Fox was also not present when the case was in court Aug. 24, Sep. 22, Oct. 18 and Nov. 15.
Mr. Fox's case was briefly addressed Feb. 14, 2018, before Justice of the Peace Jason Mariasine in Peterborough Ontario Court of Justice and adjourned until April 19, when lawyers will meet before a judge to narrow the scope of the case and vet legal issues, behind closed doors.
