On September 19th, 2017 the police were responding to a hit and run call near the neighborhood of Magiel. When the officer arrived at the destination, Magdiel was standing on the porch of the residence where he lived. 
Lt. Matthew Lindsey encountered Magdiel, who was on the porch holding a 2-foot metal pipe with a leather loop in his right hand. Officer Lindsey called for backup and Sgt. Christopher Barnes arrived. 
When the officers shouted to Magdiel to put pipe down, Magdiel walked down from the porch and began approaching one of the officers. At that moment, the two officers open fired just 15 ft away on Magdiel. He died at the scene. 
According to testimony by family members of Magdiel, they shouted at the officers that he was deaf and could not hear the demands. 
The officers say they didn't know that Magdiel was deaf. Magdiel was also not the driver of the car, it was his father. Magdiel was also not with his father when the hit and run happened. 
The officer who fired the gun, Sgt Chris Barnes, has been placed on administrative leave pending an investigation.
