On Thursday February 22, 2018, at about 2:00 a.m., Bryan Michael Penner was taken into custody on suspicion of kidnapping, theft, and criminal mischief. ^{[3] [2]}

Penner was initially arrested on a kidnap charge, and currently is facing only two counts of contempt of court for violating a restraining order filed by Gomez. He was described by Bend police as a person of interest in the case and officers stated a raid of his northeast Bend apartment turned up evidence linking him to her disappearance. ^{[3] [2]}
