Markell Hillaire allegedly slapped, beat, and smothered Jacob Marbury the one year old son of Joshua Marbury and Alicia Quinney.

In March 19 2016, Markell Hillaire who was a close friend of Joshua Marbury had been staying with the family in their Oregon home had agreed to babysit their children Jacob Marbury and his sister.

While babysitting the children Hillaire hit, dragged, and smothered Joshua Marbury in front of their three year old daughter according to Facebook post by Alicia Quinney. A previous Facebook post by Joshua Marbury about the incident was shared more than 400,000 times. ^{[5] [6] [6]}

Hilaire's aunt claims that he was drinking the night of the alleged abuse and the parents should not have left their child with him.

It took weeks for police to charge Hillarie after Joshua Marbury was let off due to a 2012 Oregon Court of Appeals ruling. The ruling made it required for abuse victims to give specific testimony about their assailant and the one year old child was not capable of taking the stand. ^[1]
