Kelly McDaniel

Kelly McDaniel is a deputy district attorney in San Joaquin, California at the San Joaquin County district attorney’s office in Stockton, Cali.
She is a member of the county's environmental protection unit.
She studied at Cal State Chico.
In 2016 she charged a woman, Mariza Ruelas, for selling homemade ceviche via a Facebook group.
After Ruelas posted about the charges in the group, McDaniel offered her a plea deal of 80 hours of community service and three years probation.
After the woman's attorney requested a jury trial Kelly attempted to add two more charges.
Mariza is part of the Facebook group 209 Food Spot, an online community of thousands of Northern Californians who share recipes, cooking tips and sometimes dishes.
She is a single mother and takes care of mother on dialysis.
After a posting to the group offering to sell ceviche, an investigator came to her house and purchased one of the 32 ounce preparations of ceviche for $12.
McDaniel said Ruelas did not obtain the necessary permits, selling food without proper inspections poses a danger to the public, and unlicensed sales undercut restaurants who do obtain the permits.
Tori Verber Salazar is listed as District Attorney in the county.
McDaniel told Fox40 News, "I don't write the laws, I enforce them.
And the legislature has felt that this is a crime.”
