In 2015, Child Protective Services sent Almena's children to live with their grandparents for 6 months. Almena has previously been arrested for unknown charges in Los Angeles and and took a plea deal in a case involving a misdemeanor charge of accepting stolen property in January 2015 for which he is still on probation. 
Involuntary Manslaughter Charges
On December 3, 2016, Derick came under public scrutiny after he made a Facebook post about his own material losses following the Oakland Warehouse Party Fire that took the lives of at least nine people with authorities expecting the number to rise. 
City officials revealed that the warehouse had no permits that allowed for a party to be held or for residential occupation.  Multiple people from the community warned Derick that the warehouse was a death trap.  The police and Fire Department were there on more than one occasion. 
Derick pleaded no contest to charges of Involuntary manslaughter along with Max Harris.  When asked what he thought about Harris and Almena receiving a plea deal instead of going to trial, one of the victim's friends said he was 'not feeling it.'
